The establishment or abolition of a State Legislative Council can be effected through
passing a resolution in respective state assembly followed by an Act in Parliament.
Presidential Ordinance on the recommendation of the Governor.
passing a Constitutional Amendment for the purpose.
passing a resolution in the Council of States.
Our constitution does not force a bicameral legislature on states. It gives states the option of having a second House.
It is left to the Legislative Assembly of each State to decide whether to recommend to Parliament abolition of the Council where one exists or to seek establishment of one if none exists. The procedure is simple and does not involve an amendment of the Constitution. The procedure prescribed is a resolution of the Legislative Assembly of the State concerned passed by a special majority followed by an act of Parliament.
As of today, seven states have Legislative Councils. These are Jammu and Kashmir, Bihar, Uttar Pradesh, Maharashtra, Karnataka, Andhra Pradesh and Telangana.
