Which one of the following has been wrongly listed as a feature of Parliament Government in India?
President stands outside the Council of Ministers
There is separation of Legislature and Executive
The leadership of the Prime Minister
Collective Responsibility of the Council of Ministers
In Indian constitution, the separation of powers is supported through Article 50, Articles 121 and 211 and Article 361. But in reality In India, a separation of functions rather than of powers is followed. Unlike in the US, in India, the concept of a separation of powers is not adhered to strictly. However, a system of checks and balances have been put in place in such a manner that the judiciary has the power to strike down any unconstitutional laws passed by the legislature. In a parliamentary form of government, the executive is not separated from the legislature in that the members of the council of ministers are members of the legislature. Hence statement 2nd is incorrect.
