74th Amendment Act of 1992 added a new Part IX-A to the Constitution of India. This part is entitled ‘The Municipalities’ and consists of provisions from Articles 243-P to 243-ZG. • Article 243V lays down that all persons who are qualified to be chosen to the State legislature shall be qualified for being a member of a Municipality. • However, the constitution in the same article specifically provided that persons who have attained the age of 21 years will be eligible to be a member of the Municipality. While the constitutional requirement is that for election to the State legislature of a state, a person must have attained the age of 25 years (Article 173). Hence, statement 1 is not correct. • The superintendence, direction, and control of the preparation of electoral rolls and the conduct of all elections to the municipalities shall be vested in the State Election Commission appointed under Article 243 K of the Indian Constitution. The state legislature may make provisions with respect to all matters relating to elections to the municipalities. Hence, statement 2 is correct.
