1st statement is incorrect. Both Simon Commission and Joint Parliamentary Comittee had rejected the iea of enacting declaration of Fundamental Rights on the ground that the abstract declaration is of no use. Although the demand of the people was not met by the British Parliament under the Government of India Act 1935 yet their enthusiasm to have such right in the Constitution was not impaired. Hence the Nehru Committee's recommendation for the Bill of Rights was included in the Constitution in 16 May 1946 by Cabinet Mission. So,2nd statement is correct.
