Maternity leave will not be granted for third child – Uttarakhand High Court :
The High Court has issued a big order regarding the Maternity Benefit Act in Uttarakhand. Accepting the special appeal of the state government, the court has quashed the order to grant leave to women in the third child under the Maternity Benefit Act.
After the court order, now women working in the state services will not get leave under the Maternity Benefit Act if they have a third child. The case was heard before the bench of Chief Justice Ramesh Ranganathan and Justice Alok Kumar Verma.
As per the case, Haldwani resident nurse filed a petition in the High Court on her third child not being given benefits under the Maternity Benefit Act. Citing the rules in the petition, the woman said that the government's rule violates the original 153 of Article 42 of the Constitution and Section 27 of the Maternity Benefit Act.
About Uttarakhand High Court :
The Uttarakhand State was carved out from erstwhile State of Uttar Pradesh on 09/11/2000. At the time of the creation of the State, the High Court of Uttarakhand was also established on the same day at Nainital. Since that day the High Court is functioning in an old building situated in Mallital Nainital which was known as old Secretariat. The building of the High Court is a very magnificent and was constructed in 1900 A.D. There is a park in front of the building and Naina Peak, the highest peak in Nainital, in the background, which makes the building more picturesque. In the beginning five Court rooms were constructed but later on more Court rooms have been added. A huge Chief Justice Court Block and a Block of Lawyers’ chambers have also been built up in the year 2007.
Hon'ble Mr Justice Ramesh Ranganathan :- Born on 28.07.1958 in New Delhi, Graduated in the year 1977, completed his Post Graduation in Commerce in the year 1981. He is also a qualified Chartered Accountant and a Company Secretary. He obtained Law Degree from Bangalore University and enrolled as an Advocate in the High Court of Andhra Pradesh in November, 1985. He was a Government Pleader from 1996 to 2000, and the Addl. Advocate General from July, 2000 to May, 2004. He appeared for several companies and statutory bodies including the N.T.R. University of Health Sciences, Visakhapatnam Port Trust, Singareni Collieries Company Limited, Power Grid Corporation of India, Canara Bank Voltas Limited etc. He was elevated as an Addl. Judge of the Andhra Pradesh High Court on 26th May, 2005. Appointed as a Permanent Judge of the Andhra Pradesh High Court on 20-02-2006 F.N. Nominated as the Executive Chairman of Andhra Pradesh Legal Services Authority, Hyderabad w.e.f. the forenoon of 29-12-2015. Appointed to perform the duties of the Office of the Chief Justice, High Court of Judicature at Hyderabad for the State of Telangana and the State of Andhra Pradesh w.e.f. the forenoon of 30-07-2016.
Transferred to High Court of Uttarakhand and assumed charge on 02/11/2018 as Chief Justice of the High Court of Uttarakhand at Nainital.
