Due to an exceptionally heavy rainfall respondent’s factory flooded with water with some oily substance which made the ground slippery. R the owners spreader available saw dust on the ground to get rid of the oily film. The slippery patches formed in the factory. P, on one of the patches slipped and sustain injury. P claimed compensation for negligence -

The compensation can be claimed as R was negligent in not closing the factory

The compensation can be claimed as R could not manage more saw-dust.

The compensation cannot be claimed as R took full care in avoiding the risk of slipping.

The compensation cannot be claimed as rainfall was not in R’s control.
