Indian Independence Act (1947) - The legislation was drafted by the Labour Government of Clement Attlee and was based totally on the Mountbatten Plan or the 3rd June Plan. Hence statement 1 is not correct. x Salient features of the Indian Independence Act 1947 are: o It declared India as an independent and sovereign state and provided for the partition of India and the creation of two new dominions- India and Pakistan. o It abolished the position of secretary of state for India also abolished the office of the viceroy and provided for each dominion, a governor-general, who was to be appointed by the British King on the advice of the dominion cabinet. o It empowered the constituent assemblies of the two dominions to frame and adopt any constitution for their respective nations and to repeal any act of the British parliament, including the independence act itself. o It granted the princely states the freedom to join either of the dominions or to remain independent. Also, the governance of each dominion was to be conducted based on the provisions of the GoI act, 1935. o It deprived the British Monarch of his right to veto bills or ask for a reservation of certain bills for his approval. But, this right was reserved for the Governor General. o The Governor General would have full power to assent to any bill in the name of His Majesty. Hence statement 2 is correct. o It discontinued the appointment to civil services and reservation of posts by the secretary of state for India. Hence statement 3 is correct. o The members of the civil services appointed before August 15, 1947 would continue to enjoy all benefits that they were entitled to till that time.
