A, a Muslim agreed in the marriage contract authorizing the wife B, to divorce her from him in the event of his marrying a second wife without her consent. After some time A married another lady ‘C’ without the consent of B. Sometime after the second marriage of A, B claimed divorce. A resists the claim contending that B lost her right as she ought to have exercised her option at the very first moment she heard the news. B contended that injury done to her is a continuing one and she has a continuing right to exercise the power. Decide.   (5 marks)
