Where the two accused were separately charged of committing murder in furtherance of a common intention, but in the charge framed against one accused, the name of the other was not mentioned, but the charges were read over to each of the accused in the presence of the other accused. In view of the above facts of the case, you are required to explain the following :-

(i) Whether there is an irregularity in the framing of the charge.

(ii) Is above mistake fatal to the conviction of the other accused.         (5 marks)
