A private complaint is filed in the Court of a First Class Magistrate for an offence exclusively triable by Court of Sessions. The Magistrate immediately ordered the Police to investigate thee matter. On receipt of the Police report the accused was summoned and was committed to the Court of Sessions for trial.  Examine the legality of the action taken by the Magistrate.
