A muslim lady S was married to G a Muslim on 11.5.1984. In March 1985, a daughter was born to her.
On account of neglect and failure to provide maintenance S filed a petition on 12.12.1986 U/S 125 Cr. P.C. claiming maintenance of Rs. 500.00 per month for herself and her infant daughter.
During pendency of the petition G married another lady SB on 4.6.1987 and kept her as his second wife.
It is argued on behalf of S that the second marriage has added new dimension to her maintenance action and she had become more entitled under the law to live separately and claim maintenance.
Write a judgement valuating the arguments, deciding the case.
