Statement 1 is correct:
The Section 33 (7) of the Representation of the People Act of 1951 which restricts candidates to contest from two constituencies. Before the amendment, candidates could contest from any number of constituencies. As per Section 29A of the Representation of the People Act, 1951, the Election Commission has the powers to register associations and bodies as political parties. However, the poll panel enjoys no such constitutional or statutory powers when it comes to deregistering political parties.
Statement 2 is not correct:
Section 8(4) of the RP Act, 1951 allowed convicted MPs, MLAs, and MLCs to continue in their posts, provided they appealed against their conviction/sentence in higher courts within three months of the date of judgment by the trial court.
