The Union government has informed the Punjab government that 'The Punjab Forfeiture of Illegally Acquired Property Act, 2017'passed by the state legislative assembly on November 29, 2017.It is not in conformity with the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985. and the Prevention of Money Laundering Act(PMLA) Act,2002.
The Act would provide for forfeiture of properties of those convicted in drug trade under the Narcotic Drugs and Psychotropic Substances Act (NDPS Act), 1985. It also provides for attaching of property after registration of a case so that the undertrial in these cases is not able to dispose of the properties before the conviction. Property older than six years at the time of the registration of the case will not be attached or confiscated under the provisions of the new Act.
The Narcotic Drugs and Psychotropic Substances Act, 1985, commonly referred to as the NDPS Act, is an Act of the Parliament of India that prohibits a person to produce/manufacture/cultivate, possess, sell, purchase, transport, store, and/or consume any narcotic drug or psychotropic substance.
Prevention of Money Laundering Act, 2002 is an Act of the Parliament of India enacted by the NDA government to prevent money-laundering and to provide for confiscation of property derived from money-laundering. PMLA and the Rules notified there under came into force with effect from July 1, 2005. The Act and Rules notified there under impose obligation on banking companies, financial institutions and intermediaries to verify identity of clients, maintain records and furnish information in prescribed form to Financial Intelligence Unit - India (FIU-IND).
