The Rajasthan state government has brought a bill that amends the Rajasthan Public Examination (Prevention of Unfair means) Act, 1992.
The new amendment is intended to give the government the power to exclude public examinations from the purview of the Act.
The new bill Rajasthan Public Examination (Prevention of Unfair means) Amendmen Bill, 2022 proposes to amend the existing Section 8 of the Act.
Section 8 provides for the state government to include in the Schedule any public examination in respect of which it considers necessary to apply the provisions of this Act.
But the problem lies in the fact that there is no provision for exclusion of any public examination from the Schedule to the said Act.
Therefore, the state government has considered it expedient that the executive should also have the power to exclude any public examination from the Schedule to the said Act if it considers any public examination to be governed by a new enactment.
