According to Pollock and Mulla, the Specific Relief Act, 1963, is essentially a procedural law. It has been called procedural because, it does not create any legal right rather it provides only an additional remedy. However, it cannot be said to be procedural in the same sense as the other procedural laws, like the Civil Procedure Code, 1908; the Indian Evidence Act, 1872; and the Criminal Procedure Code, 1973. The Specific Relief Act, 1963 does not essentially provide for the proceedings, and hence it cannot be said to be purely procedural, rather it is substantive also, for like other substantive laws it provides for the remedies as well; but, it cannot be said to be purely substantive, as it does not create, as such, any legal rights.
