On production of a certified copy of the foreign judgment, the presumption as to the competency of the court, under section 14 of Code of Civil Procedure, 1908 isa:-
presumption of fact
presumption of fact &. law both
rebuttable presumption of law
irrebuttable presumption of law
Section 14 of the Code declares that the Court shall presume, upon the production of any, document which is a certified copy of a foreign judgment that such judgment was pronounced by a Court of competent jurisdiction, unless the contrary appears on the record; but such presumption may be displaced by proving want of jurisdiction. Thus section 14 comes under the category of shall presume and is thus rebuttable.
