Section 156(2) of Cr PC takes care and cures:
any irregularity in the conducting of investigation by the police officer
any illegality in the conducting of investigation by the police officer
both (a) and (b)
only (a) and not (b).
- Section 156(2) of the CrPC says proceedings in any case are not to be set aside just because there was an irregularity or error in the investigation conducted by a police officer.
- This means if the investigation is not done in a perfect or regular manner (irregularity), the case or trial cannot be quashed for that alone.
- However, if there is "illegality," which means a fundamental violation of legal provisions (e.g., lack of jurisdiction or blatant abuse of process), the law does not protect such investigations.
- So, only irregularities are "cured" and not illegalities.
- Option 1 and Option 4 are very close, but the correct one is:
Option 4: only (a) and not (b).
