Sedition under section 124 A is the Communication with the intention of exciting disaffection, hatred or contempt against the government established by law. It involves - Bringing or attempting to bring in to hatred; or exciting or attempting to' . excite disaffection against the government of India, And such act or attempt may be done by words, either spoken or written, or by sins or by visible representation. The act must be intentional. Criticism of the government or policies and administrative and other actions of the government, if done without exciting or attempting to excite hatred, contempt, or disaffection towards the government established by law is not sedition.Mere exciting disaffection without incitement to violence does not amount to sedition. (Kedarnath. Singh v. State of Bihar) The essence of the crime of sedition is the intention of the writer, speaker as the case may be of the seditious matter. However intention alone is not punishable in crime, it should be followed by some act or omission.
