To raise the defence of unsoundness of mind, person should be incapable of knowing the nature of the act or that he is doing what is either wrong or, contrary to law. Irresistiblè or Uncontrollable impulses cannot be raised as a defence. The cases in which insanity affects only the emotions and the will subjecting the offender to impulses, and leaves the cognitive, faculties unimpaired have been left out of the exception. The reason being the object of criminal law is to make people control their insane as well as sane impulses and to guard against mischievous properties and homicidal impulses. It is not a defence neither in India nor in England.
