Under Section 6. of the Specific Relief Act, 1963, a person cannot sue for recovering the possession of immovable property;
After six months from the date of dispossession
After nine months from the date of dispossession
After twelve months from the .date of dispossession
After twenty-four months from the date of dispossession
This section was incorporated in the Act with a view to provide a summary ,, cheap and useful remedy to a person dispossessed . of immovable property, without following the due process of law. The objects of section 6 are as under: 1. . to discourage people from taking the law in to their own hands, however good, their title maybe..2. to provide a summary, cheap and useful remedy to a person dispossessed of immovable property otherwise than in due course oflaw. Further application of this section is limited to cases where the plaintiffproves that: 1., he was in juridical possession of the immovable property in dispute. 2. he had been dispossessed without his consent and otherwise than in due course of law 3. the dispossession took place within 6 months from the date of the suit.
