he seller of the goods is deemed to be an "unpaid" seller within the meaning of this act - when the whole of the price has not been paid or tendered or when a bill of exchange or other negotiable instruments has been received as con ditional payment, and the condition on which was received has not been fully by reason of the dishonor of the instrument or otherwise (Section 45). An unpaid seller under section 46 can exercise the following rights - An unpaid seller of goods, as such, has by implication of law— a lien on the goods for the price while he is in possession of them; in case of the insolvency of the buyer a right of stopping the goods in transit after he has parted with the possession of them; a right of re-sale as limited by this Act.
