Against an order of high court rejecting or granting the application for issue of write of Habeas Corpus, an appeal -

can lie to the other High Court.

can lie to the Supreme Court.

can lie to SC only if certificate to that effect is issued by high court.

The Constitution of India has given the power to issue writs to the Supreme Court in Article 32. This power is wider in case of High Courts as the Supreme Court has restricted powers when it comes to issuing writs. The difference is given below:
The Supreme Court can issue writs only in case there is a violation of Fundamental Rights.
The High Court has a wider scope to exercise this power. They can issue writs not only when there is a violation of Fundamental Rights but also in other cases.

Rules of Court, 1952, are the rules made by this Court "in exercise of the powers conferred by Article 225....... and all other powers enabling it in that behalf". Chapter XXIII deals with appeals to the Supreme Court. Rule 2 requires that a petition for leave to appeal shall contain a brief statement of the case and the grounds of appeal. Rule 3 provides that the period of limitation for a petition for a certificate under Article 132 or 133 is governed by Article 179 of the Limitation Act. After the record has been prepared, it is required by Rule 18 to be transmitted to the Supreme Court.
