Secondary evidence may be given of the existences, condition or contents of a document in the following cases. When the document is in the possession of –

(i) The person by whom it is to be proved,

(ii) Any person out of the reach of, or not subject to, the process of the court,

(iii) Any person who is legally bound to produce it but does not produce it after notice to

produce the same.
