Civil Procedure Code (CPC) 1908 Plaint and Written Statement

Where a party from whom a written statement is required under Rule 1 or Rule 9 of Order VIII CPC , fails to present it within the time fixed by the Court, the Court –

Shall pronounce a Judgment against him; or,

Make such order in relation to the suit as it thinks fit.

Either A or B

Shall pronounce Judgment only and not to pass any other order in relation to the suit because the time prescribed by the above provisions is already expired.
