Under Section 60 of the CPC, an agreement by which a person agrees with his free consent to waive the benefit of any exemption -

Shall be voidable at the option of the party who has waived the benefit

Shall be valid because the person himself has waived the benefit with his own free consent

Shall be void even if waived the benefit with his free consent

Shall not be void rather legally valid

Agreement to waive the benefit – shall be void. [Section 60 clause (IA) inserted by the Act 1976 CPC].
