Under Section 104 of the CPC, an appeal shall not lie from the following orders —

An order under Section 35A CPC

Order under Section 91 CPC or Section 92 CPC refusing leave to institute a suit of the nature referred to in Section 91 CPC or Section 92 CPC, as the case may be.

Order under Section 91 CPC and Section 92 CPC allowing leave to institute a suit of the nature referred to in Section 91 CPC or Section 92 CPC, as the case may be.

An order under Section 95 CPC.

Under Section 104 (1) (ffa) CPC, an appeal shall lie from an order under section 91 or section 92 refusing leave to institute a suit of the nature referred to in section 91 or section 92, as the case may be and not from allowing to leave to institute a suit.
