A purchased a stamped paper in the name of a person whose name he intended to forge, A is guilty of -
Attempt of cheating.
Attempt of criminal misappropriation.
Attempt of forgery.
No offence.
- Option 1: Attempt of cheating
Cheating involves deceiving someone to cause wrongful gain or loss. Simply buying stamped paper with someone else’s name, even with intent to forge, doesn’t amount to attempting to cheat unless further dishonest acts are done.
- Option 2: Attempt of criminal misappropriation
Criminal misappropriation means using someone else’s property dishonestly. Purchasing stamped paper doesn’t fit this as the paper was bought, not misappropriated.
- Option 3: Attempt of forgery
Forgery requires making or altering a document with intent to cause it to be believed that it was made by someone else. Buying stamped paper in another’s name with intent to forge is an act towards forgery, so this could be seen as an attempt at forgery.
- Option 4: No offence
Merely purchasing stamped paper is not, by itself, an offence. But if purchase is made with intent to forge, it may attract attempt to commit forgery.
