When the property is not produced before the court pending or during the inquiry or trial, the disposal of property shall be governed by:
section 454 of Cr PC
section 455 of Cr PC
section 457 of Cr PC
section 458 of Cr PC.
- Section 454 of CrPC deals with the disposal of property at the conclusion of trial. It does not cover property not produced before the court during inquiry or trial.
- Section 455 of CrPC allows the court to order the destruction of libellous and other objectionable matter after conviction.
- Section 457 of CrPC relates to the procedure for disposal of property not produced before a court if certain conditions are met. It governs the situation where the police seize property and report it to the Magistrate, who can then make orders regarding its disposal.
- Section 458 of CrPC provides for the disposal of property seized when violent resistance is offered.
