Civil Procedure Code (CPC) 1908 Appearance and Non Appearance of Parties

When, on the day to which the hearing of the suit is adjourned, the parties or any of them fail to appear:

Order XVII, Rule 2 of CPC shall apply

Order XVII, Rule 3 of CPC shall apply

both Order XVII, Rule 2 and Order 17, Rule 3 of CPC shall apply

neither Order XVII, Rule 2 of CPC nor Order 17, Rule 3 of CPC shall apply.

Order XVII, Rule 2 of CPC shall apply
