Where the Magistrate takes cognizance of the offence on a complaint made to him and considers, before the issue of process to the accused that the matter should be investigated, such investigation can be ordered, under:
section 156(3) of Cr PC
section 190 of Cr PC
section 173(8) of Cr PC
section 202 of Cr PC
- Option 1: Section 156(3) of Cr PC
- This section allows a Magistrate to direct the police to investigate a cognizable case before taking cognizance of the complaint. It is generally used before cognizance is taken.
- Option 2: Section 190 of Cr PC
- It deals with various modes through which a Magistrate can take cognizance of an offence. It is related to the commencement of proceedings.
- Option 3: Section 173(8) of Cr PC
- It provides for further investigation by police even after a chargesheet is filed. It is not related to directing an investigation before issuing process.
- Option 4: Section 202 of Cr PC
- This section allows a Magistrate, after taking cognizance, to order an investigation to decide whether there is enough ground to proceed against the accused.
