Two successive transfers of the same property by sale or mortgage cannot co-exist; the later in date must give way to the earlier.

Where there are two encumbrances on the same property, the first encumbrance must be first satisfied, and if necessary, it can exclude the second. 

The mortgagee who is first in time has priority over a subsequent mortgagee of the same property.
