Sec. 14 (3) is in the nature of an exception to Order XXIII, Rule 2, C.P.C. It gives a benefit to the plaintiff:

Where a suit has been withdrawn under Order XXIII, Rule 1, C.P.C., with permission to file a fresh one.

Where the suit is dismissed after adjudication on its merits.

Both (a) and (b).

Only (b).

Where a suit has been withdrawn under Order XXIII, Rule 1, C.P.C., with permission to file a fresh one.
