Parliament has the cardinal functions of legislation, control of executive and ventilation of people grievances. Other functions are
• Providing the cabinet
• Control of the cabinet: cabinet remains in power as long as they enjoy confidence of the majority in the house – Article 75(3)
• Criticism of Individual members and cabinet: policies come into wider deliberation and discussions
• An organ of information: Ministers provides answers authoritatively through question and answer section in the Parliament.
It is the Judiciary not parliament that adjudicates disputes and administers justice under criminal law. In addition, the higher judiciary (Supreme Court and High Courts) acts as the custodian of the Constitution because it is responsible for its interpretation and enforcement.
The Judges of Indian courts are appointed by two ways.
Supreme court Judges:- They are appointed by President, consultancy with Chief justice of India. Their are some eligibility criteria for that. He should be the judge of high court for more then five years.
High court judges:- They are appointed by President of India, consultancy with Governor of states. The eligibility criteria is that person should have experience for ten years as an advocate. They are not specified or no exam for they. Anyone having good experience and good profile advocate can be selected.
Lower judiciary:- There is an exam for lower judiciary. Every person want to be a magistrate have to give exam of judiciary which are conducted by every state. This is the smallest post of judge. With time and good services, this judge can be a high court judges in last year's of service. But very few selected for it.
Parliament highlights the people’s grievances. Eg: Question hour, half-an-hour discussions, various types of motions and resolutions.
