• The declaration of National Emergency has effects both on the rights of individuals and the autonomy of the states. The Fundamental Rights under Article 19 are automatically suspended and this suspension continues till the end of the emergency. But 44th amendment act of 1978 restricted the scope of article 358 due to which fundamental rights under article 19 gets automatically suspended only on grounds of War or external aggression and not on grounds of armed rebellion.

• Positive rights are those which confer certain privileges on the person. For example, Right to religious freedom (Article 25-28) and cultural and educational right (Article 21 a). Therefore, it's the nature of the right that classifies them as negative or positive.
