Article 124(4) of the constitution and the Judges (Inquiry) Act 1968 together lay down an elaborate procedure for the removal of the Supreme Court judge. It involves following steps: • A motion for the removal of a judge, signed by at least 100 members of Lok Sabha or 50 members of Rajya Sabha is delivered to the presiding officer of the house. • The presiding officer constitute a committee of three jurists to investigate the motion. • If the committee recommends the removal of the judges, the report of the committee is taken up for the discussion. • If the motion is passed in each house by a majority of the total membership the House and by a majority of not less than two-thirds of members present and voting, the address is presented to the President • Finally, president gives order for the removal of the judge. Therefore, it is the President who removes the judge, not the speaker or chairman. The same procedure is followed for high court judges as well.
