Consider the following statements regarding retired judges of Supreme Court:
1. They are barred from pleading or acting in any court within the territory of India.
2. There is a cool off period of two years before they are installed in other government offices.
Which of the above statements are correct?
1 Only
2 Only
Both 1 and 2
Neither 1 nor 2
A Person who has retired as a judge of the Supreme Court is debarred from practicing in any court of law or before any other authority in India. However, they can be appointed by the government as the heads of various commissions.
Note: There is no cooling off period of Indian judges as of now. There is a demand from certain sections of the society that there should be a cool off period of two years before they are appointed to any other post. This is to avoid political favouritism while they are in Supreme Court.
