What could be the possible outcome if ‘right to constitutional remedies’ is removed from the Indian Constitution?
Indian polity will cease to be a democratic polity.
Indian citizens will not be able to approach the courts at all.
The government could easily infringe upon Fundamental Rights of the people and acquire a totalitarian character.
The principle of separation of powers will be diluted
Statement 1 is incorrect as even if there is no such right to remedies and the government is elected by the people it will be a democratic polity.
Statement 2 is incorrect as even in absence of right to constituional remedies people can approach courts agaisnt violation of other legal rights
Statement 3 is correct as the Fundamental rights act as a constraint on the executive and imposes negative obligations over it to safeguard the rights of citizens. So if the guarantee to fundamental rights which is assured by the right to constitutional remedies is removed the executive may infringe upon fundamental rights and acquire a totalitarian character.
Statement 4 is incorrect as this is not related to separation of powers
