Amended Maternity Benefits Act, 2016 passed by the Parliament to raise maternity leaves for working women in formal sector from 12 weeks to 26 weeks for two surviving children. Only Canada with 50 weeks and Norway with 44 weeks as paid maternity leaves are ahead of India. The commissioning women (biological mother who uses her egg to create an embryo planted in any other woman) adopting child below the age of 3 months will be entitled for 12 weeks’ maternity leave.
The bill provides crèche facility in all workplaces that has either 30 women employees or 50 employees in total with mother being allowed to visit the crèche 4 times during working hours. The employer may allow the women employee to work from home. The onus of educating women about their rights under the bill lies on the employer.
