First statement is incorrect. The Law Commission of India has recommended the Centre to ratify the United Nations Convention Against Torture and frame a standalone anti-torture law directly making the State responsible for any injury inflicted. Though India had signed the U.N. Convention Against Torture in 1997, it is yet to ratify it. Second statement is incorrect. Prevention of torture bill, 2010 was introduced to torture as Indian Penal Code and Criminal Procedure Code have sufficient provisions to deal with cases of Custodial Torture. Third statement is correct. Law Commission of India in its 273rd Report recommended the implementation of 'United Nations Convention against Torture and other Cruel, Inhuman and Degrading Treatment or Punishment' through Legislation. Torture has been a contentious issue having a direct bearing on the right to life and liberty of an individual. The Commission is of the opinion that such heinous acts must be curbed through strong legislation providing stringent punishment, which will act as a deterrent.
