Consider the following statements about State Legislative Councils or Vidhan Parishad and identify the incorrect one/ones
1. The members of the Legislative Councils are partially nominated and partially directly elected by the people.
2. The Legislative Councils are permanent chambers of legislation not subject to dissolution in any case except during declaration of President's Rule.
3. A money bill can be introduced in the Legislative Councils but they do not have any voting powers on it.
Select the correct answer using codes given below
1 and 2 only
1 and 3 only
2 and 3 only
All of the above
First statement is incorrect as 1/6th members are nominated by the Governor on the basis of their special knowledge / practical experience in literature, art, science, cooperative movement or social service. In legislative Council, other different categories of representation is given below- • 1/3rd of the total membership is elected by the electorates consisting of the members of the self Governing bodies in the state such as Municipalities, District Boards etc. • 1/3rd members are elected by the members of the Legislative assembly of the State • 1/12th members are elected by an electorate of University Graduates. • 1/12th members are elected by the electorate consisting of the secondary school teachers (3 year experience) Second statement is incorrect. The legislative council is permanent body but 1/3rd of its member retire every 2 years. It is not dissolved even during President's rule. The power of abolition and creation of the State legislative council is vested in Parliament of India as per article 169. But again, to create or to abolish a state legislative council, the state legislative assembly must pass a resolution, which must be supported by majority of the strength of the house and 2/3rd majority of the present and voting (Absolute + Special Majority). The resolution to create and abolish a state legislative council is to be assented by the President also. Third statement is incorrect. Money Bills originate only in Assembly. After they are passed in the Assembly it is sent to the Council which can only make recommendations on it.
