Which of the following statement regarding the Attorney General of India is correct?
As per the Constitution, the Attorney General is appointed for a fixed term of five years.
He/she is entitled to all the privileges of a Member of Parliament including the right to appear at the proceedings of Parliament without the right to vote.
The Attorney General of India comes under the purview of RTI.
He/she is the Chief Law officer of Government of India and is hence debarred from private legal practice.
First option is incorrect. The term of office of the AG is not fixed by the Constitution.
Second option is correct. In the performance of his official duties, the Attorney General has the right of audience in all courts in the territory of India. Further, he has the right to speak and to take part in the proceedings of both the Houses of Parliament or their joint sitting and any committee of the Parliament of which he may be named a member, but without a right to vote.
Third option is incorrect. The relationship between the government and its top law officer was privileged and could not be disclosed to the public. Hence Delhi High Court has ruled that AGI does not come under the purview of RTI.
Fourth option is also incorrect. However, the Attorney General is not a full-time counsel for the Government. He does not fall in the category of government servants. Further, he is not debarred from private legal practice provided he is not appearing against the government.
