In case of conflict among two or more judgements of the Supreme Court, which of the following judgement is followed or considered as final?
Latest judgment given by Supreme Court.
Judgment given by larger bench.
Any of the judgements as deemed fit by the court.
Such situation has not been clarified by the Supreme Court or is provided under the Indian Constitution.
It is well-settled that if there are two conflicting judgments of the Supreme Court, of Benches with equal number of Judges, then the latter will prevail over the earlier. But where the earlier judgment is of a larger Bench and the latter judgment is of a smaller Bench, then the decision of the larger Bench will be binding.
