The Supreme Court of India tenders advice to the President on a matter of law or fact

only if he seeks such advice

on its own initiative

only if the issue poses a threat to the unity and integrity of the country

only if the matter relates to the Fundamental Rights of citizens

Under Article 143, President has to the power to consult Supreme Court on his own on matters of:

on any question of law or fact of public importance wich has arisen or which is likely to arise.
On any dispute arising out of any pre-constitution treaty, agreement, covenant, engagement, samad, or similar intruments.

The constitutional cases or references make by president under this article are decided by a bench of atleast 5 judges.

NOTE: USA Supreme Court has no advisory jurisdiction.
