Statement 1: Constitution has not fixed the term of Rajya Sabha and it is left to the Parliament. Representation of People Act 1951, provided the term of RS as 6 years. The act also empowered the president to curtail the term of members chosen in first RS.
Statement 2: Normal term of LS is 5 years. However president is authorised to dissolve LS even before expiry of the term, this cannot be challenged in court of law. Term of LS can be extended during national emergency by a law of parliament for one year. This extension cannot continue beyond 6 months after the emergency ceased to operate.
