Consider the following statements with reference to the Civil Services.
1) The Parliament is authorized to protect persons in the service of the union or a state in respect of any action taken by them during martial law to maintain or restore order.
2) All India services are under the ultimate control of the state government even though the civil servants are appointed by the Centre and recommended by the UPSC.
Which of the above is/are correct?
1 only
2 only
Both 1 and 2
None
Correct : Statement 1: Articles 33 and 34 authorises the Parliament to do so. The Armed Forces Special Powers Act has been made on the basis of these provisions. This Act has created tensions between the people and the armed forces on some occasions.
Incorrect : Statement 2: The all-India services are common to the entire territory of India and officers chosen for these services serve in the administration of the States. But, these officers for e.g. belonging to the IAS are under the ultimate control of the central government. States cannot take disciplinary action nor can they remove these officers from service.
