A239-A provides for the creation of local Legislatures or Council of Ministers or both for certain Union territories.-
Parliament may by law create for the Union territory of Pondicherry -
Any such law as is referred to in clause (1) shall not be deemed to be an amendment of this Constitution for the purposes of Article 368 notwithstanding that it contains any provision which amends or has the effect of amending this Constitution.

In the first place, you must not hold any office of profit under the Government of India or the Government of any Union Territory other than an office declared by law made by Parliament or by the Legislative Assembly of the Union Territory of Pondicherry not to disqualify its holder. The Pondicherry Legislative Assembly has passed the Pondicherry members of the Legislative Assembly (Prevention of Disqualification) Act, 1994.
