Consider the following statements.
Assertion (A): It is an Indian citizen’s fundamental duty to abide by the constitutional laws.
Reason (R): What is illegal in India cannot be a fundamental duty, and what is legal must be a fundamental duty.
In the context of the above, which of these is correct?
A is correct, and R is an appropriate explanation of A.
A is correct, but R is not an appropriate explanation of A.
A is correct, but R is incorrect.
Both A and R are incorrect.
To abide by the Constitution and respect its ideals and institutions, the National Flag and the National Anthem” is the first FD listed under part-IV of the constitution. FDs are largely in sync with legal duties. What is illegal cannot be a fundamental duty, and what is a fundamental duty has also been made a legal duty (e.g. respecting women). But, this does not mean that what is legal must be a fundamental duty, for e.g. it is legal to pay taxes, but paying taxes is not a fundamental duty. While FDs can be enforced by legislative processes (for e.g. Environment Protection Act that helps enforce the individual duty of environment protection), the constitution explicitly does not enforce them via legal provisions or does not explicitly mention in Part IVA that there are legislative processes to enforce them.
