Article 262 of the Constitution empowers the Parliament to make law for the adjudication of inter-state water disputes. The first tribunal under the Inter-State Water Disputes Act was set up for Krishna River in 1969. The decision of the tribunal set up under the Inter-State Water Disputes Act cannot be challenged in any court and it is binding on the parties. Though award is final and beyond the jurisdiction of Courts, either States can approach Supreme Court under Article 136 (Special Leave Petition) under Article 32 linking issue with the violation of Article 21 (Right to Life.
