The Preamble is non-justiciable in nature and it does spell out the philosophy of the Constitution, but it was based on the Objectives Resolution and not on the Poorna Swaraj Resolution. Preamble can be amended under Article 368 because it was declared as a part of the Constitution by the Supreme Court in Kesavananda Bharti Case (1973), and anything that is a part of the Constitution can be amended as per the procedure mentioned in Article 368.
