The Fundamental Rights can be suspended only:
If Supreme Court pass the order
If President order for the same at the time of National Emergency
If Parliament passes a Law by two third majority
Thy can never be suspended
When a proclamation of national emergency is made, only the six Fundamental Rights under article 19 are automatically suspended. The President can suspend the enforcement of other FR’s except those under Articles 20 to 21.
